These Terms of Sale govern consumer purchases of physical products from RBCOM through rbcomshop.com for delivery in France.
1. Seller identity and scope
The seller is RBCOM, a French simplified joint-stock company with a sole shareholder (SASU), share capital EUR 1,500, registered with the Lyon Trade and Companies Register under number 825 053 002, SIRET 825 053 002 00010, VAT number FR27 825053002, with registered office at 577 Avenue General de Gaulle, 69760 Limonest, France.
These terms apply to orders placed by consumers through rbcomshop.com. They form part of the contract together with the order summary and the policies linked below. Mandatory French and European consumer rights prevail over any inconsistent provision.
2. Product information
The essential characteristics of each product are described on its product page. Customers should review the description, dimensions, materials, intended use and care information before ordering. Photographs are intended to represent products faithfully, but screen display and reasonable production tolerances may cause minor non-material differences.
3. Prices and delivery charges
Prices are displayed in euros and include applicable French VAT unless clearly stated otherwise. Delivery charges are shown separately before the order is confirmed. Standard delivery costs EUR 7.99 and is free when the merchandise subtotal reaches EUR 65 after discounts and before delivery charges.
RBCOM may change prices for future orders. The price charged is the price displayed when the customer submits the order, except in the event of an obvious pricing error that a reasonable customer should have recognized. If an obvious error occurs, RBCOM may cancel and refund the order or invite the customer to confirm it at the correct price.
4. Ordering process and contract formation
The customer selects products, reviews the cart, provides delivery and billing details, chooses an available payment method, reviews the final total and confirms an order through the checkout control indicating an obligation to pay.
An automated acknowledgment confirms receipt of the order but does not prevent RBCOM from rejecting an order for legitimate reasons such as unavailable stock, payment failure, suspected fraud, delivery restrictions or an obvious error. The sale is accepted when RBCOM sends confirmation of acceptance or dispatches the order. If an order is rejected after payment authorization, the corresponding amount will be released or refunded without undue delay.
5. Payment
Payment is due when the order is placed. The payment methods actually available are displayed at checkout. Payments are processed through secure third-party providers. RBCOM does not require customers to provide complete payment-card details through ordinary customer-service messages.
The customer confirms that they are authorized to use the selected payment method. RBCOM may suspend or cancel an order if payment is refused, reversed or reasonably suspected to be fraudulent, subject to applicable law.
6. Product availability
Orders are subject to availability. If a product becomes unavailable after ordering, RBCOM will inform the customer and refund the unavailable product without undue delay. Where appropriate, RBCOM may offer an alternative, but no substitution is made without the customer agreement.
7. Delivery
Orders are accepted for delivery in France at addresses supported by checkout. Processing normally takes one to three business days. Estimated carrier transit is three to five business days after dispatch. Tracking is provided.
If delivery is materially delayed, the customer may require performance within an additional reasonable period and may then terminate the contract if delivery still does not occur, except where the customer is legally entitled to cancel immediately because the agreed date was essential. Refunds following lawful cancellation for non-delivery will be made as required by law.
Full delivery terms are available at https://rbcomshop.com/policies/shipping-policy.
8. Transfer of risk and retention of title
For consumer sales, risk passes when the customer or a designated third party other than the carrier physically receives the goods. RBCOM retains ownership until full payment has been received, without affecting the transfer-of-risk rule or mandatory consumer protections.
9. Right of withdrawal
A consumer generally has fourteen calendar days after receipt to notify RBCOM of a decision to withdraw without giving a reason. After notice, the goods must be returned without undue delay and no later than fourteen days. The customer pays direct return shipping costs for a change-of-mind return.
RBCOM refunds the amounts required by law, including the least expensive standard outbound delivery cost when the entire order is withdrawn, no later than fourteen days after receiving the withdrawal notice. RBCOM may withhold reimbursement until the goods are received or evidence of dispatch is provided.
The right of withdrawal does not apply where a statutory exception applies, including goods made to the customer specifications or clearly personalized. The customer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Instructions and the model withdrawal form are available at https://rbcomshop.com/policies/refund-policy.
10. Legal guarantee of conformity
RBCOM is liable for defects covered by the French legal guarantee of conformity under Articles L.217-3 and following of the French Consumer Code. For new goods, a consumer may invoke this guarantee for two years from delivery. The consumer is entitled to have the goods brought into conformity, normally by repair or replacement, without charge and within the period required by law. Where the statutory conditions are met, the consumer may obtain a price reduction or terminate the contract.
The legal guarantee applies independently of any commercial guarantee and independently of the fourteen-day withdrawal right.
11. Hidden defects
The customer also benefits from the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code. A hidden defect must have existed at the time of sale and make the product unfit for its intended use or substantially reduce that use. The action must generally be brought within two years after discovery of the defect, subject to the applicable long-stop period. The customer may seek cancellation of the sale or an appropriate price reduction under the legal conditions.
12. Complaints and customer service
Complaints may be submitted to support@rbcomshop.com or through https://rbcomshop.com/pages/contact. Customer service hours are Monday to Friday, 9:00 a.m. to 5:00 p.m. Central European Time, excluding French public holidays. Include the order number and information reasonably needed to assess the request.
13. Liability and force majeure
RBCOM is responsible for direct loss caused by breach of contract in accordance with applicable law. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer guarantees, fraud, wilful misconduct or liability for death or personal injury caused by negligence.
RBCOM is not liable for delay or failure caused by an event beyond its reasonable control to the extent recognized by applicable law. RBCOM will take reasonable steps to limit the effect and will inform affected customers when appropriate. Mandatory cancellation or refund rights remain available where their legal conditions are met.
14. Personal data
Personal data is processed as described in the Privacy Policy at https://rbcomshop.com/policies/privacy-policy.
15. Evidence and electronic communications
Electronic records maintained through the store, payment systems and communications may be used as evidence of transactions, subject to the customer right to provide contrary evidence and the rules of applicable law. Order confirmations and contractual information may be supplied electronically to the email address provided by the customer.
16. Severability and waiver
If a provision is invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right.
17. Governing law and disputes
These terms and orders are governed by French law. This choice does not deprive a consumer of mandatory protections granted by the law of their habitual residence where applicable. Courts with jurisdiction are determined by mandatory procedural and consumer rules.
18. Changes
The terms applicable to an order are those available when the order is submitted. RBCOM may update these terms for future orders by publishing a revised version with a new last-updated date.
